The following are the terms of an agreement between you (Customer) and EV FireSafe. By agreeing to these
terms you acknowledge that you have read, understand, and agree to be bound by these terms and to comply
with all applicable laws and regulations, including export and re-export control laws and regulations.
EV FireSafe may, without notice to you, at any time, revise these Terms of Trade and also make improvements
or changes in the products, services, or programs described in this document at any time without notice.
1.1 Licence and Permission1.1.1. All Training content is copyright and remains the property of EV FireSafe. Materials may not
be reproduced, adapted, or exploited by any means.
1.1.2. The number of course licences purchased is accessible for 12 months from provision of
Customer access to EV FireSafe Training or 12 months from scorm file sent date.
1.1.3. At the end of 12 months, if licences are not renewed, Customer access to training content
will expire.
1.1.4. Customers who choose to access Training content through EVFS Training will access the
latest version of the Content for the duration of the licence agreement.
1.1.5. Customers who choose to receive the purchased Training content as a SCORM file will only
receive the one version. If licence is renewed at the end of the 12 months, and if there is an
updated version of the course, Customers will receive the latest version.
1.1.6. For Customers who are using Training content via a SCORM file, EV FireSafe holds no
responsibility for the continued use of information past the 12 months licence period.
1.1.7. Each licence access is strictly for a single user; sharing login credentials or distributing
materials to others is grounds for immediate licence termination without refund.
1.1.8. System Requirements: EV FireSafe holds no responsibility for technical issues on the
Customers end, such as slow internet or incompatible devices.
1.2 Online Course Payments and Refunds1.2.1. On acceptance of the quote, this becomes the contract of sale.
1.2.2. Full online course payments are required upfront.
1.2.3. Access to online training is provided on payment of invoice.
1.2.4. Unused licences at the end of the 12 month period are non refundable
2.1 Session Attendance2.1.1. EV FireSafe will in good faith deliver agreed session(s) to the number of participants
Customer has specified per session. Customer must advise in advance if participant
numbers exceed what was quoted; additional fees may apply.
2.1.2. If pre-requisites are required, Customer is to ensure that all participants have met the
requirements.
2.1.3. All participants are expected to participate in a supportive and respectful, professional
environment. This requires treating EV FireSafe personnel and fellow participants with
courtesy, valuing diverse perspectives, and engaging in constructive dialogue. Bullying,
harassment, discrimination, or disruptive behaviour—including inappropriate use of
technology or unauthorised recording—will not be tolerated.
EV FireSafe reserves the right to terminate any session (with no refund) where inappropriate,
unprofessional behaviour is exhibited.
2.1.4. Any form of session recording for face to face or virtual sessions, including AI recording is
prohibited unless previously negotiated and authorised by EV FireSafe.
2.2. Onsite / Live Sessions Payments and Refunds
2.2.1. On acceptance of the quote, this becomes the contract of sale.
2.2.2. Full payment is required 7 days prior to the final session delivery date training date.
If split payments have been negotiated then:
- 2.2.2.1. 50% of full invoice amount is payable within 7 days of initial Invoice Sent Date
- 2.2.2.2. Remaining 50% is payable 7 days prior to the final session delivery date.
2.2.3. Refunds are not available if participant attendance numbers are less than what was quoted.
2.2.4. EV FireSafe will provide a full refund of the costs of any session if EV FireSafe needs to cancel
and rescheduling with Customer is not possible .
2.2.5. If payment is not received by the due date, a late fee of 5% of total invoice amount per week
overdue will may be applied to the outstanding balance at the discretion of EV FireSafe.
Services may be suspended or cancelled until payment is received
3.1. Customisation over/above currently designed Training course will be charged extra based on either a task
by task rate or by requesting an estimate of work to be carried out.
3.2. Final customization requirements must be sent by Customer and accepted by EV FireSafe prior to EV
FireSafe commencing customisation development. EV Firesafe will accept 1 review and update cycle
from Customer post customization development
4.1. EV FireSafe collects learner information necessary to provide, manage, and improve Customers’ learning
experience within our LMS. This data includes, but is not limited to:
- 4.1.1. Profile Data: Name, email address, job title, and organization.
- 4.1.2. Activity Data: Courses accessed, time spent, quiz/assessment results, progress tracking,
and completion dates.
- 4.1.3. Interaction Data: Messages and feedback provided within the system.
4.2. EV FireSafe uses this data to verify Customers’ identity, track educational progress, provide technical
support, and fulfill legal reporting requirements.
4.3. Access to Customers’ Learner data is restricted to authorised staff and administrators on a "need-to-
know" basis.
4.4. By registering for or using EV FireSafe LMS, you consent to the collection, processing, storage, and usage
of your learner data as described in document.
4.5. Payments made via EV FireSafe online payment platform is integrated with Xero. Payment details are
processed securely by Xero’s authorised third‑party payment service provider Stripe. EV FireSafe does not
collect, store, or retain Customers’ payment card details within Xero or its own systems. Payment
information is handled in accordance with applicable security standards, including PCI‑DSS
requirements, by the payment provider Stripe.
4.6. While EV FireSafe takes reasonable steps to protect data and strives to maintain a secure environment,
our services are provided 'as-is' and do not warrant that our security measures will prevent third-party
breaches services are provided without guarantees of uninterrupted security
4.7. Customers are responsible for maintaining the confidentiality of your own account information, including
password security. EVFireSafe is not liable for any data breach caused by Customers failure to secure own
login credentials and devices.
5.1. Cancellation Policy: EV FireSafe requires minimum 14 days cancellation request via email to
hello@evfiresafe.com from Customer prior to any onsite/ virtual sessions to be eligible for a refund.
Customer is liable to cover travel or expenses have been incurred by EV FireSafe prior to the cancellation
request.
5.2. While we have made every attempt to ensure the information contained is from reliable sources, EV
FireSafe are not responsible for any errors or omissions, or for the results obtained from the use of training
information. All information in in our training content, presentations, reports and on our websites
evfiresafe.com and evfiresafe.training is provided 'as is' with no guarantee of completeness, accuracy,
timeliness or of the results obtained from the use of this information, and without warranty of any kind,
express or implied, including, but not limited to fitness for a particular purpose. In no event, will either
entity, or its related partnerships, agents or employees be liable to you or anyone else for any decision
made or action taken which relies on the information in this site, or for any consequential, special or
similar damages, even if advised of possibility of such damages.
